Public Hearing Notice for Board of Adjustment Meeting February 27, 2020

PUBLIC NOTICE

 

A public hearing will be held by the Board of Adjustment on Thursday, February 27, 2020 at 7 p.m. in Town Council Chambers located at 900 7th Avenue, to consider the following applications. Sworn testimony from those members of the general public affected may be received at this meeting.  Following the public hearing, the Board of Adjustment may take action on these requests.

 

Appeals

A-20-01 115 Owensboro Court – JLS Homes has requested a variance from the rear setback specified in Section 188 of the 1984 Land Use Ordinance brought forth and referenced in Article 4.14(D)(8) of the Garner Unified Development Ordinance (UDO). The applicant is specifically requesting a 10-foot reduction from the specified 35-foot front setback. The property is located at 115 Owensboro Court, Raleigh and can be further identified as Wake County PIN# 1609-17-1759. (MAP HERE)

 

A-20-02 124 Maraketch Court – JLS Homes has requested a variance from the rear setback specified in Section 188 of the 1984 Land Use Ordinance brought forth and referenced in Article 4.14(D)(8) of the Garner Unified Development Ordinance (UDO). The applicant is specifically requesting a 10-foot reduction from the specified 35-foot front setback. The property is located at 124 Maraketch Court, Raleigh and can be further identified as Wake County PIN# 1609-09-8978. (MAP HERE)

 

A-20-01 107 Owensboro Court – JLS Homes has requested a variance from the rear setback specified in Section 188 of the 1984 Land Use Ordinance brought forth and referenced in Article 4.14(D)(8) of the Garner Unified Development Ordinance (UDO). The applicant is specifically requesting a 10-foot reduction from the specified 35-foot front setback. The property is located at 115 Owensboro Court, Raleigh and can be further identified as Wake County PIN# 1609-19-1740. (MAP HERE)

 

The Board of Adjustment is a "quasi‑judicial" Board which acts as a court.  Its members are appointed by the Town Council to serve three-year terms.  All testimony received is "sworn" testimony.  At the meeting, the Secretary will read the request as written on the agenda.  The Planning Staff will explain how the request does or does not meet the requirements of the UDO.  The Applicant, after being sworn in, testifies and presents facts and other testimony regarding the case.  The proponents or opponents then have the opportunity to provide testimony, after being sworn in.  The Applicant may rebut any testimony given.

All persons interested in or affected by the above applications are invited to attend the hearing.  Additional information is available during regular business hours from the Planning Department.
