Legal Notice - Board of Adjustment Meeting January 23, 2020
A public hearing will be held by the Board of Adjustment on Thursday, January 23, 2020 at 7 p.m. in Town Council Chambers located at 900 7th Avenue, to consider this application. Sworn testimony from those members of the general public affected may be received at this meeting. Following the public hearing, the Board of Adjustment may take action on this request.
A-19-04, 117 Lyle Road – Roslyn Minor has requested a variance from the rear setback specified in Section 188 of the 1984 Land Use Ordinance brought forth and referenced in Article 4.14D of the Garner Unified Development Ordinance (UDO). The applicant is specifically requesting that she be allowed to put a roof and screen enclosure over an existing deck that was permitted to encroach up to 7.5 feet into the 25-foot rear setback. The property is located at 117 Lyle Road, Raleigh and can be further identified as Wake County PIN# 0699-67-1147.
The Board of Adjustment is a "quasi‑judicial" Board which acts as a court. Its members are appointed by the Town Council to serve three-year terms. All testimony received is "sworn" testimony. At the meeting, the Secretary will read the request as written on the agenda. The Planning Staff will explain how the request does or does not meet the requirements of the UDO. The Applicant, after being sworn, testifies and presents facts and other testimony regarding the case. The proponents or opponents then have the opportunity after being sworn to provide testimony. The Applicant may rebut any testimony given.
